  2. To be eligible, the following criteria must be met:
    a. The claimant must submit an application to Oceania Village Company Limited (“Oceania”) for the occupation of an independent living apartment (“Apartment”) at Eden retirement village (“Application”).
    b. The Application must be submitted between 1 October and 30 November 2021.
    c. The Application must be accepted by Oceania.
    d. The ‘cooling-off’ period under section 28 of the Retirement Villages Act 2003 in relation to the claimant’s occupation right agreement for the Apartment must have expired.
    e. The claimant must occupy the Apartment before 31 March 2022.
    f. The claimant must pay to Oceania the Occupation Licence Payment, as set out in the Application, before 31 March 2022.
    Claimants who meet this criteria will be “Eligible Claimants”, and the Voucher will be provided to the Eligible Claimant once all criteria are met.
  3. Vouchers are not available for people who submit an application for a Care Suite at Eden.
  4. Vouchers are not transferrable and cannot be exchanged for cash.
  5. Only one Voucher per Apartment is available.
  6. An Eligible Claimant must either return the Voucher to Oceania or, if the Voucher has been used to purchase an Ahipara Luxury Travel holiday, refund the value of the Voucher to Oceania if the Eligible Claimant terminates their occupation right agreement with Oceania for the Apartment in accordance with the 90 Day Right Place Guarantee set out in the occupation right agreement. The return of the Voucher or refund of the Voucher (as the case may be) to Oceania must be made within 30 working days of the Eligible Claimant terminating the occupation right agreement.

    a. If the Eligible Claimant cancels their Application before taking occupation of the Apartment;
    b. If the Eligible Claimant terminates their occupation right agreement with Oceania for the Apartment within the ‘cooling-off’ period under section 28 of the Retirement Villages Act 2003;
    c. If the Eligible Claimant terminates their occupation right agreement with Oceania for the Apartment in accordance with the 90 Day Right Place Guarantee set out in the occupation right agreement with Oceania.
    The return of the Voucher or refund of the Voucher (as the case may be) to Oceania must be made within 30 working days of either (a), (b) or (c) occurring.
